  30. [1] DEFINITIONS:  "Program" means the shareware version of WarCraft II: Tides
  31. of Darkness consisting of the files listed below.  The "Trademarks" consist
  32. of Blizzard Entertainment and the Blizzard Entertainment logo.

  34. [2] OWNERSHIP:  Blizzard Entertainment owns and reserves the exclusive right
  35. to distribute the Program, and to use the Trademarks in connection with it.
  36. Its content, layout and format are the property of Blizzard Entertainment to
  37. the extent permitted by law.

  39. [3] GRANT AND CONDITIONS:  Blizzard Entertainment grants a non-exclusive
  40. license to distribute the Program on compatible media under the
  41. Trademarks subject to the following conditions:

  43.   CONDITIONS FOR FREE DISTRIBUTION:

  45.   [A] All of the Program's files, including this one, must be included as
  46. released by Blizzard Entertainment, without modification.   
  47.  
  48.   [B] No copyright or trademark information contained or displayed in the
  49. original files may be removed.

  51.   [C] You must not [a] distribute any version of the Program with unauthorized
  52. changes, such as additional or different levels, or changed characters or
  53. scenarios; or [b] characterize such versions as an "add-on" or "extension" of

  56. [4] LIMITED WARRANTY AND LIMITATION OF REMEDIES: If Blizzard Entertainment
  57. provides a physically defective copy of the Program,  Blizzard Entertainment
  58. will replace that copy upon submission of the defective one.  Aside from
  59. this, the Program IS PROVIDED "AS-IS", AND NO WARRANTIES OF ANY KIND
  60. (INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR
  61. PURPOSE), EXPRESS OR IMPLIED, ARE MADE AS TO IT OR ANY MEDIUM IT MAY BE ON.
  62. OUR ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY IS SUCH REPLACEMENT, AND
  63. UNDER NO CIRCUMSTANCES WILL WE PROVIDE ANY OTHER REMEDY FOR DIRECT, INDIRECT,
  64. SPECIAL, CONSEQUENTIAL, PUNITIVE, INCIDENTAL OR OTHER DAMAGES ARISING FROM IT,
  65. INCLUDING SUCH FROM NEGLIGENCE, STRICT LIABILITY, OR BREACH OF WARRANTY OR
  66. CONTRACT, EVEN AFTER NOTICE OF THE POSSIBILITY OF SUCH DAMAGES.

  68. [5] MISCELLANY:  For all distribution or other activity regarding the Program
  69. for which registration with Blizzard Entertainment or Blizzard Entertainment
  70. consent or approval is required, the following provisions shall apply.

  72.   [A] Since Blizzard Entertainment would be irreparably damaged if Section
  73. [3] or [5][D] were not specifically enforced, we will be entitled
  74. without bond, other security or proof of damages, to appropriate equitable
  75. remedies with respect to breaches of such sections, in addition to such
  76. other remedies as we may have.

  78.   [B] You will hold Blizzard Entertainment, our partners, contractors,
  79. employees and agents harmless from damage, loss and expense arising directly
  80. or indirectly from your acts and omissions in copying and distributing the
  81. Program.

  83.   [C] With respect to every matter arising under this, you consent to the
  84. exclusive jurisdiction and venue of the state and federal courts sitting in
  85. Irvine, California, and to service by certified mail, return receipt
  86. requested, or as otherwise permitted by law.

  88.   [D] You will not modify, reverse compile, disassemble, or reverse engineer
  89. the Program, or use or disclose any confidential information that it contains.
